Sellers Agent/Listing Agent

A seller’s agent, also known as a listing agent, exclusively represents the seller’s interests with unwavering good faith, loyalty, and fidelity. This agent negotiates on behalf of and advocates for the seller throughout the transaction process. They are obligated to disclose to potential buyers any adverse material facts about the property that they are aware of. Additionally, a separate written listing agreement is necessary to outline the specific duties and obligations of both the broker and the seller.

Buyer’s Agent

A buyer’s agent operates exclusively in the best interests of the buyer, prioritizing their needs with unwavering honesty, loyalty, and dedication. This agent negotiates and advocates on behalf of the buyer throughout the transaction process. They are responsible for disclosing to potential buyers any adverse material facts they are aware of, including the buyer’s financial capacity to fulfill the transaction terms and, in the case of residential properties, whether the buyer intends to occupy the property. Furthermore, a separate written buyer agency agreement is essential to delineate the specific duties and responsibilities of both the broker and the buyer.

Additional Duties of Buyer’s or Seller’s Agent

If the Buyer/Seller Agency box is checked, the Broker has additional duties, including promoting the interests of the buyer/seller with utmost good faith, loyalty, and fidelity; seeking acceptable prices and terms, and counseling them on any material benefits or risks of a transaction that are actually known by the broker.

Transaction-Broker

A transaction-broker plays a pivotal role in real estate transactions, providing assistance to both buyers and sellers as needed. They execute the terms outlined in any written or oral agreements, ensure all parties are fully informed, and present all offers for consideration. Additionally, they aid in navigating contracts and oversee the closing process, all while maintaining a neutral stance and not advocating for either party. It’s imperative for a transaction-broker to demonstrate reasonable skill and care in fulfilling their obligations and to disclose any adverse material facts they are aware of, including details about the property or the buyer’s financial capacity to meet transaction terms. Although no written agreement is mandatory, the transaction-broker’s responsibilities remain consistent with those of agents.
